General Terms of Sale

“Love Paris Picnic”  has the business of selling picnics and related services online, with delivery in the Paris region.

“Love Paris Picnic”  includes marketing of picnics and related services through the www.loveparispicnic.com website. The list of goods and services offered for sale online can be found on this website.

In undertaking an order on the website, the Customer agrees that relations with “Love Paris Picnic”  will be exclusively governed by this contract, excluding any condition previously available on the website of “Love Paris Picnic” .

“Love Paris Picnic” reserves the right to modify, at any time, these terms and conditions by posting a new version on the Site. The terms and conditions are those in effect on the date of validation of the order. Photos of goods and services on the site have no contractual value.

Article 1 – Purpose

The purpose of this Agreement is to define the rights and obligations of the Parties under the Online Sale of Goods and Services offered for sale by “Love Paris Picnic”.

Article 2 – Scope

These Terms and Conditions shall apply only to consumers, as defined under the law and case law, acting exclusively on their own account.

In accordance with Articles L. 111-1 and L. 111-3 of the Consumer Code, the essential characteristics and prices of goods and services sold electronically available on the Site.

Furthermore, the customer receives the information specified in Articles L. 121-8 and L. 121-19 of the Consumer Code, prior to and after the conclusion of the sale and in particular by means of these Conditions of Sale.

These Conditions of Sale are applicable to all sales of Goods and Services occurred through the Site.

The Customer declares to have read these Terms and Conditions before Validation of the Order within the meaning of Article 5. Validation of the Order is acceptance without limitation or qualification of these Conditions of Sale.

These Terms and Conditions are applicable for orders carried out to a delivery in Paris.

Article 3 – Entry Into Force and Duration

This Agreement shall enter into force on the validation date of the Order as defined in Article 5. The Agreement is concluded for the duration necessary for the provision of goods and services, until the expiry of the guarantees and obligations owed by ” Love Paris Picnic “.

Article 4 – Control of Goods and Services and Concluding Steps of Online Sale

In order to achieve the Order, the Customer will be required to follow the following steps:

1. Visit the Site and follow the instructions on the Site
2. Fill in the order form. In case of prolonged inactivity during the connection, it is possible that the selection of goods and services selected by the Customer before this inactivity is no longer guaranteed. The customer is then prompted to resume its selection of goods and services from the beginning.
3. Check the items in the order and, where appropriate, identify and correct errors.
4. Validate the Order, the deposit amount if required, the price and the Total Price All Inclusive (the “Validation of the Order”)
5. Follow the instructions to complete online payment (if the payment is made online only). Once your order is placed, we would ask you to pay the full amount of your picnic via paypal for non EU members. EU members have the option to pay via wire transfer. All bank charges are to be taken care of by the client including the 4.6% paypal fee.
6. The customer then receives electronically an immediate confirmation of the Order and payment acceptance with the full amount or the paid deposit and remaining balance due.
7. The customer also receives electronically a confirmation of the Order (the “Order Confirmation”).
8. Delivery will take place at the delivery date, time and address agreed with the Client in the Order placed on the website or via following emails. All of our picnics are at present delivered at the champ de Mars. A different location can be set via email for our ” Edith Piaf ” Picnic.

At the completion of the various steps in the above order, the Customer agrees to comply with these contract terms pursuant to Article 1316-1 of the Civil Code.

“Love Paris Picnic”  will honor the Order only in the stocks of goods. In the absence of availability of goods,”Love Paris Picnic” undertakes to inform the Customer.

However, in accordance with Article L. 122-1 of the Consumer Code,”Love Paris Picnic”  reserves the right to refuse the order if it is abnormal, passed in bad faith or for any other legitimate reason, in particular, when there is a dispute with the Client regarding payment of a previous order.

Article 5 – Prices of Goods and Services and Conditions of Validity

The prices for Goods and Services sold on the Site are indicated respectively by article and reference or by delivery and by reference. At the time of validation of the Order, the price means the price all inclusive. Telecommunications costs inherent in accessing the Site are the sole responsibility of the Customer. The period of validity of tenders and price is determined by discounting the Site.

Article 6 – Payment Terms

When done online, payment of the all-inclusive or deposit price is carried out via Paypal by the Client. Payment (with prior agreement) can also be made in cash upon delivery while the remaining balance of a payment is due in “cash only” at delivery.

Pursuant to Article L. 132-2 of the Monetary and Financial Code, undertaking to pay by means of Paypal is irrevocable.

“Love Paris Picnic”  implements all reasonable means to ensure the confidentiality and security of data transmitted on the Site.

Article 7 – Delivery of the Order

7.1. Delivery Address

The Customer is solely responsible for a delivery failure due to a lack of indication in the Order. Refer to our FAQ page for details.

7.2. Amount of Delivery Costs

The amount of shipping and handling depends on the amount of the order and the delivery method chosen by the Customer. In any event, the amount of delivery fee is indicated by the Customer Validation of the Order. Refer to our FAQ page for details.

7.3. Delivery Schedule

Delivery schedule will be decided by the Client based on the information indicated on the Site.

7.4. Delay Delivery

In case of late delivery, the Order is not cancelled.”Love Paris Picnic”  will inform the Customer that the delivery will occur late. The customer can then decide to cancel the order and send by email to Paris Picnic notice of cancellation of the Order.”Love Paris Picnic” will then proceed to refund the amounts debited disbursed by the Client within fifteen (15) days.

7.5. Checking the Order on Arrival

Customer is responsible for checking the condition of the packaging and the items upon delivery. The Customer reserves the right to refuse the Picnic if the Picnic is obviously damaged. Said reservations and complaints should be addressed to the carrier and Paris Picnic.

Article 8 – Intellectual Property Rights

The brand “Love Paris Picnic”  and all other trademarks, illustrations, images and logos appearing on the Site, accessories and packaging, whether registered or not, remain the exclusive property of Paris Picnic. Total or partial reproduction, modification or use of these marks, illustrations, images and/or logos for any reason and on any medium whatsoever, without the express prior consent of”Love Paris Picnic”, is strictly prohibited. It is the same to any combination or conjunction with any other mark, symbol, logo and more generally any distinctive sign intended to form a composite logo. It is the same for any copyright, drawings, models and patents are the property of “Love Paris Picnic”.

Article 9 – Data Privacy

The information requested from the Customer is required to process the Order. In the event that the Customer agrees to provide individual personal data, s/he has an individual right to access, delete and correct such data in accordance with Law No. 78-17 of 6 January 1978 on computers, files and freedoms. The Customer must send a request in writing via email. On the occasion of the creation of his account on the Site, the Customer will be able to choose whether to receive offers from”Love Paris Picnic”  and partners.

Article 10 – Force Majeure

The performance by “Love Paris Picnic” and its obligations under this Agreement shall be suspended upon the occurrence of a fortuitous event or force majeure that would impede or delay the execution. In this event,”Love Paris Picnic”  will notify the Customer of the occurrence of such a fortuitous event or force majeure as soon as possible after its occurrence. The Customer may then terminate the order and “Love Paris Picnic”  will refund the Order under the conditions referred to in Article 7.

Article 11 – Nullification of a Contract Clause

If any provision of this Agreement is cancelled, this shall not entail the nullity of the other provisions of the Contract which will remain in force between the Parties.

Article 12 – Party Independence

Neither party can make any commitment on behalf and / or on behalf of the other Party. Furthermore, each Party remains solely responsible for its allegations, commitments, services, products and personnel.

Article 13 – No Waiver

The failure of either party to claim a commitment by the other Party of any obligations under the present cannot be interpreted in the future as a waiver of the requirement cause.

Article 14 – Applicable Law

This Agreement shall be governed by French law.

Article 15 – Jurisdiction

Any dispute arising from the formation, interpretation or execution of this Agreement shall be within the exclusive jurisdiction of the courts of Paris, despite multiple defendants or warranty.

Article 15 – Cancellation and refund

We do not refund picnics. In case of light rain, we may decide to set up the picnic at a romantic sheltered area with the view of the eiffel tower on the champ de Mars. In case of heavy rain or heavy wind which would make the picnic not enjoyable to take place..

Please note that we cater for one picnic per day. Once you have reserved your date, we do not take any other booking from clients. This is the reason why we do not refund and propose to move the picnic to a different date. The picnic can be postpone to the next season / following year.
